Limited Liability Indemnity

This page sets out the limits of our liability, and your indemnity to us, when you use nfthydroponics.shop or buy from Hydroponics Company Canada, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions.
Your rights under the law come first
Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any right under the consumer protection law of your province or territory that cannot be given up. Where those rights apply, they take priority over anything on this page.
The law in some provinces may not allow some of the limits or exclusions below. If the law where you live does not allow a limit on this page, that limit does not apply to you.
Limitation of our liability
Subject to the section above, and to the fullest extent the law allows:
- We are not liable for any indirect, consequential, special, incidental, punitive or exemplary loss, or for loss of profit, revenue, data or goodwill, however it arises. This applies whether the loss comes from using a product or from not being able to use it, including interruptions or delays.
- Where we are liable, our total liability to you for any claim is limited to the amount you paid for the goods the claim relates to.
- We are not liable for loss or damage caused by misuse of a product, by not following its instructions, or by normal wear and tear.
- We are not liable for delivery delays outside our control, or for a product becoming unavailable. If we cannot supply something you have paid for, we refund you in full.
Using our products
Unless a product page says otherwise, we do not claim that any of our products will prevent injury or loss. Please use each product as its page and its instructions describe. Except where we have acted fraudulently or with wilful misconduct, and subject to your rights above, you are responsible for how you use the products, and for any damage to you, your property or anyone else that comes from using them.
Website availability and third parties
We try to keep the site available and working, but it is provided "as is" and we do not promise uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice.
We are not responsible for fraud, theft, hacking, interception, tampering or other unlawful acts by third parties that are outside our control.
This site and our products are meant for customers in Canada. Please do not buy or use them anywhere that doing so would break the local law.
Your indemnity
You agree to cover us for any reasonable losses, costs and claims, including reasonable legal fees, that we incur because you have broken our Terms & Conditions, misused this site or a product, or infringed another person's rights through your use of the site.
